1. About PurePixelz

PurePixelz is an AI-powered image upscaling and enhancement service. We use advanced neural networks to upscale images to up to 4K resolution. The service is operated by PurePixelz.

2. Eligibility

To use PurePixelz, you must:

• Be at least 13 years of age (or the legal minimum age in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be located in a country subject to applicable trade embargoes or sanctions
• Provide accurate and complete registration information

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@purepixelz.com if you suspect any unauthorized access to your account.

You are responsible for all activity that occurs under your account. We reserve the right to terminate accounts found to be in violation of these Terms.

4. Credits & Payments

4.1 Credit System

PurePixelz operates on a prepaid credit system. Credits are purchased in packs and deducted each time you enhance an image (1 image = 1 credit).

• Credits are non-transferable and cannot be exchanged for cash
• Credits do not expire as long as your account remains active
• Credit balances are displayed in real-time in your dashboard
• We reserve the right to modify credit pricing with reasonable advance notice

4.2 Payments

All payments are processed by Paddle.com, our Merchant of Record. Paddle is responsible for billing and collects payment on our behalf. All prices are listed in USD unless otherwise stated and include applicable taxes where required.

4.3 Refund Policy

Because our service delivers a digital result immediately upon processing, the following refund policy applies:

• Unused credits: You may request a full refund of unused credits within 14 days of purchase by contacting support@purepixelz.com
• Partially used packs: Refunds will be prorated based on the number of unused credits remaining
• AI processing failures: If a credit is consumed but the AI processing failed through no fault of your own, we will restore the credit to your account
• No refunds after 14 days: Requests made after 14 days from purchase will not be eligible for a refund

Refund requests are processed by Paddle on our behalf. Please contact us at support@purepixelz.com to initiate a refund request.

5. Acceptable Use

You agree to use PurePixelz only for lawful purposes. You must NOT use the service to process or generate:

• Images that are illegal, abusive, or violate any applicable laws
• Content that infringes on the intellectual property rights of others
• Child sexual abuse material (CSAM) or any sexualized imagery of minors
• Content intended to harass, threaten, or harm any individual or group
• Deepfake images intended to deceive or defame real individuals without their consent
• Images for use in disinformation campaigns or political manipulation

Violation of this section may result in immediate account termination and reporting to relevant authorities.

6. Intellectual Property

6.1 Your Images

You retain full ownership of all images you upload and the enhanced images you download. By uploading images, you grant PurePixelz a limited, non-exclusive license solely to process your images for the purpose of providing the upscaling service.

6.2 Our Service

The PurePixelz platform, including its design, code, branding, and AI pipeline, is our intellectual property. You may not copy, reproduce, or reverse-engineer any part of our service without written permission.

7. Service Availability & Limitations

We strive to maintain a high-availability service, but we do not guarantee uninterrupted access. PurePixelz may experience downtime due to:

• Scheduled maintenance (we will try to provide advance notice)
• Third-party service outages (Supabase, Replicate, hosting provider)
• Unforeseen technical issues or force majeure events

We are not liable for any losses arising from service unavailability, provided we act in good faith to restore service promptly.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT THE AI OUTPUTS WILL MEET YOUR SPECIFIC EXPECTATIONS. RESULTS MAY VARY DEPENDING ON THE QUALITY AND CONTENT OF THE INPUT IMAGE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PUREPIXELZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account at any time if:

• You violate these Terms of Service
• We detect fraudulent activity or abuse of the credit system
• You use the service to process prohibited content
• We are required to do so by law

If we terminate your account for reasons other than a Terms violation, we will refund any unused credits you hold.

11. Changes to These Terms

We may update these Terms of Service at any time. We will notify you of material changes at least 14 days in advance via email or a prominent notice on our website. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or the service shall be resolved through good-faith negotiation. If unresolved, disputes will be subject to binding arbitration or the courts of competent jurisdiction.
